Armando Betancourt, de 45 años, colaborador del sitio Nueva Prensa Cubana y fundador de la revista clandestina El Camagüeyano, ya ha cumplido un año de cárcel sin sentencia. El periodista fue detenido por la Policía Nacional Revolucionaria (PNR) el 23 de mayo de 2006 en Camagüey (Centro). Reporteros sin Fronteras pide su libertad.

„El único error de Armando Betancourt fue ejercer su profesión de periodista. No existe ningún motivo serio que justifique su detención, y los propios magistrados admiten que hay contradicciones en los testimonios que rodean las circunstancias de su detención. La duda, y la falta de cargos, deberían beneficiar al acusado. Armando Betancourt tiene que recuperar la libertad“, ha declarado Reporteros sin Fronteras.

El 23 de mayo de 2006 la policía intento expulsar a algunas familias que habían ocupado un vertedero en Camagüey. Armando Betancourt acudió al lugar para cubrir el acontecimiento. El periodista empezó a preguntar a las personas presentes, que protestaban por el brutal carácter de la intervención policial. Unos agentes de la Policía Nacional Revolucionaria (PNR) le ordenaron que se identificara, y le detuvieron cuando dijo que era un periodista independiente. El 29 de mayo, Armando Betancourt fue trasladado a la tercera unidad de la PNR de Camagüey, sometido a aislamiento y después encarcelado, el 6 de junio de 2006, en la cárcel Cerámica Roja, de la misma ciudad.

El 8 de febrero de 2007 el periodista, acusado de „alterar el orden público“, compareció ante el tribunal municipal de Camagüey (Centro). Inmediatamente el juicio quedó aplazado porque los magistrados consideraron „contradictorias“ las declaraciones de algunos testigos y agentes de la Seguridad del Estado (policía política).

Cuba sigue siendo la segunda mayor cárcel del mundo para los periodistas con 25 encarcelados, 20 de los cuales están internados desde la „primavera negra“ de marzo de 2003 y condenados a penas que van de 14 a 27 años de cárcel. De los cinco periodistas detenidos después, a dos no le han juzgado y a tres les han condenado a penas de tres y cuatro años de cárcel. _____________­_____________

INDEPENDENT JOURNALIST COMPLETES A YEAR IN PRISON WITHOUT TRIAL

Reporters Without Borders reiterated its call for the release of Armando Betancourt, 45, as he today completed a year in detention without trial. A contributor to the Nueva Prensa Cubana website and founder of the underground magazine El Camagüeyano, he was arrested by the National Revolutionary Police (PNR) on 23 May 2006 in the central city of Camagüey.

„Betancourt's only offense was to work as a journalist,“ the press freedom organisation said. „There are no serious grounds for holding him and even the judges have acknowledged inconsistencies in the testimony about the circumstances of his arrest. Given the element of doubt and absence of any charge, Betancourt should be freed.“

Betancourt went to cover the eviction of families squatting at a dump in Camagüey on 23 May 2006 and began to question some of the people present, who were protesting against the heavy-handed police operation. The police approached Betancourt and asked him to identify himself. When he said he was an independent journalist, he was immediately arrested.

On 29 May 2006, he was transferred to the premises of the PNR's 3rd detachment in Camagüey and placed in solitary confinement. From there, he was transferred to Camagüey's Cerámi­ca Roja prison on 6 June 2006.

He was brought before the Camagüey municipal court on a charge of „disturbing the peace“ on 8 February of this year, but the trial was quickly adjourned after the judges found that the statements provided by witness and members of the State Security (the political police) were „contradictory.“

Cuba continues to be the world's second biggest prison for the press, with a total of 25 journalists detained. Twenty of them were arrested in the „Black Spring“ crackdown of March 2003 and are serving jail terms ranging from 14 to 27 years. The other five have been arrested since then. Two of them have never been tried and three are serving prison sentences of between three and four years. _____________­_______________

UN AN DE PRISON SANS JUGEMENT POUR LE JOURNALISTE INDÉPENDANT ARMANDO BETANCOURT

Collaborateur du site Nueva Prensa Cubana et fondateur de la revue clandestine El Camagueyano, Armando Betancourt, 45 ans, a déjà purgé un an de prison sans jugement. Le journaliste avait été arrêté par la Police nationale révolutionnaire (PNR), le 23 mai 2006 Ã  Camagüey (Centre). Reporters sans frontières demande sa libération.

„Le seul tort d'Armando Betancourt est d'avoir exercé sa profession de journaliste. Aucun motif sérieux ne justifie sa détention et les magistrats ont eux-mêmes admis des contradictions dans les témoignages entourant les circonstances de son arrestation. Le doute et l'absence de charge devant profiter à l'accusé, Armando Betancourt doit recouvrer la liberté“, a déclaré Reporters sans frontières.

Le 23 mai 2006, la police avait tenté d'expulser des familles qui squattaient dans une décharge à Camagüey. Armando Betancourt s'était rendu sur les lieux pour couvrir l'événement. Le journaliste avait commencé à interroger les personnes présentes, qui protestaient contre le caractère musclé de l'intervention. Des agents de la Police nationale révolutionnaire (PNR) l'avaient sommé de décliner son identité, puis l'avaient arrêté lorsqu'il avait déclaré être un journaliste indépendant. Le 29 mai, Armando Betancourt avait été transféré à la troisième unité de la PNR de Camagüey et placé à l'isolement avant d'être incarcéré, le 6 juin 2006, à la prison Cerámica Roja, dans la même ville.

Le 8 février 2007 le journaliste, accusé de „trouble à l'ordre public“, a comparu devant le tribunal municipal de Camagüey (Centre). Le procès a été aussitôt reporté, les magistrats estimant „contradictoires“ les dépositions de témoins et d'agents de la Sécurité de l'État (police politique).

Cuba reste la deuxième prison du monde pour les journalistes avec 25 emprisonnés, dont 20 détenus depuis le „printemps noir“ de mars 2003 et condamnés à des peines allant de 14 Ã  27 ans de prison. Parmi les cinq autres journalistes incarcérés depuis, deux n'ont jamais été jugés et trois ont été condamnés à des peines de trois à quatre ans de prison.

Freedom of expression, association and movement continued to be severely restricted. At least 69 prisoners of conscience remained imprisoned for their political opinions. Political dissidents, independent journalists and human rights activists continued to be harassed, intimidated and detained, some without charge or trial. Cubans continued to feel the negative impact of the US embargo.

Background

During 2006 Cuba secured a place on the UN Human Rights Council and assumed the presidency of the Non-Aligned Movement during its XIV Summit in Havana in September.

In July, Fidel Castro underwent surgery and for the first time since 1959 transferred his responsibilities to other senior officials, including his brother, Raúl Castro Ruz. Political opposition parties and activities were not tolerated.

Political relations with the USA remained tense despite economic exports of agricultural products to Cuba exceeding US$500 million. The US Commission for Assistance to a Free Cuba issued an update of its previous report in July. The European Union did not reintroduce sanctions lifted in 2005 despite continued concerns over the human rights situation in Cuba.

The US government set up a law enforcement task force to track down and prosecute those who circumvent restrictions on travelling and commercial exchanges with Cuba. In November, for the 15th consecutive year, the UN General Assembly passed a resolution calling on the USA to end its embargo on Cuba.

The government continued to deny the UN Special Rapporteur on the human rights situation in Cuba access to the country. AI and other independent human rights organizations were also not allowed to visit.

Prisoners of conscience

At the end of the year, 69 prisoners of conscience continued to be held for their non-violent political views or activities. Twelve others continued to serve their sentences outside prison because of health concerns. No releases of prisoners of conscience were reported during the year.

• Orlando Zapata Tamayo was sentenced to three years in 2003 on charges of showing „contempt to the figure of Fidel Castro“, „public disorder“ and „resistance“. In November 2005 he was reportedly sentenced to an additional 15 years for „contempt“ and „resistance“ in prison. In May 2006, he was again tried on the same charges and sentenced to an additional seven-year term. He was serving a prison sentence of 25 years and six months.

Detention without charge or trial

Scores of people continued to be held without charge on suspicion of counter-revolutionary activities or on unclear charges. Their legal status remained unclear at the end of the year.

• Prisoner of conscience Oscar Mariano González Pérez, an independent journalist who was arrested in July 2005 as he was about to take part in a demonstration in front of the French embassy, remained in detention without charge or trial.

Freedom of expression and association

Severe restrictions on freedom of expression and association persisted. All print and broadcast media remained under state control. There was a rise in the harassment and intimidation of independent journalists and librarians. People suspected of links with dissident groups or involved in promoting human rights were arrested and detained. There was an increase in arrests on charges of „pre-criminal dangerousness“. Access to the Internet remained severely limited outside governmental offices and educational institutions. Journalist Guillermo Fariñas staged a seven-month hunger strike to obtain access to the Internet, without success.

• Armando Betancourt Reina, a freelance journalist, was arrested on 23 May as he took notes and photographs of evictions from a house in the city of Camagüey. He was charged with public disorder. Armando Betancourt was reportedly held incommunicado for a week at the police station before being transferred to Cerámica Roja prison in Camagüey on 6 June. He was awaiting trial at the end of the year.

Harassment and intimidation of dissidents and activists

There was an increase in the public harassment and intimidation of human rights activists and political dissidents by quasi-official groups in so-called acts of repudiation.

• Juan Carlos González Leiva, President of the Cuban Foundation for Human Rights, was reportedly the target of several „acts of repudiation“ – involving government supporters reportedly acting with the collusion of the authorities – at his home in the city of Ciego de Avila. He and his family were repeatedly threatened by demonstrators. Juan Carlos González Leiva, who is blind, was arrested in March 2002 for „disrespect“, „public disorder“, „resistance“ and „disobedience“ and spent two years in prison without trial. In April 2004 he was sentenced to four years' imprisonment, to be served at his home.

CIEGO DE ÁVILA, Cuba – 6 de mayo (Tania Maceda Guerra, CPIC / www.cubanet.org) – Rebecca Rodríguez Souto, esposa del Dr. Alfredo Manuel Pulido López, prisionero de conciencia del Grupo de los 75, informó que Pulido sufre de tuberculosis, de acuerdo con los resultados de una prueba de Mantoux que le realizaron los médicos del Ministerio del Interior y la Seguridad del Estado.

Dijo Rodríguez Souto que la prueba le fue practicada al Dr. Pulido el viernes 27 de abril y que los familiares están extremadamente preocupados por esta condición que pone en riesgo la vida de su esposo.

La fuente explicó que al enfermo le pusieron un tratamiento, que ella desconoce, bajo el cual deberá permanecer durante varios meses. Dijo además, que toda esta información le fue suministrada por teléfono por una doctora de los servicios médicos del Ministerio del Interior.

Rodríguez Souto aseguró que la prueba se debió a un pesquisaje general en todo el destacamento donde Pulido López se encuentra encerrado, ya que los carceleros sospechan que existe un brote de tuberculosis. Agregó que su esposo padece de múltiples enfermedades, entre ellas: hemorroides, amigdalitis, gastritis, neuralgia occipital.

Alfredo Manuel Pulido López, de 46 años de edad, es estomatólogo y cumple una condena de 14 años en la prisión camagüeyana de Kilo 7. Su familia reside en calle Palomino # 445, Reparto la Mascota, Camagüey.

The Czech Foreign Ministry has denied claims by the Cuban authorities that the Czech Republic is to become a safe refuge for Cuban terrorist Luis Posada Carilles, who is accused by Cuba and Venezuela of terrorism. Last week a US court released Carriles from custody on bail.

„Unfortunately, this is a case of a deliberate campaign aimed at discrediting us,“ Czech Foreign Ministry spokeswoman Zuzana Opletalova told Pravo.

According to Cuban sources, the choice of the Czech Republic as a „velvet asylum“ was negotiated with Czech diplomats even before the decision of the Texas court, where Carriles, a one-time CIA operative, was facing charges of violating immigration regulations.

The asylum for Carriles is supposed to have been negotiated by Cuban American Pedro Navajo, who has „a close tie to the CIA.“ According to Cuban authorities the idea of negotiating with the Czechs originally came from Frank Calzon, one-time executive director of the Cuban American National Foundation, an organization of Cuban emigrants in the United States, on the basis of the precedent set by the Czech Government, which over the last few months has accepted several Cubans who have been detained by the US Coast Guard while attempting to emigrate from the island and temporarily held at the Guantanamo base.

Accepting Cubans normal practice

„Accepting Cubans is connected with Czech foreign policy. This is a case of people persecuted by the regime,“ Dzamila Stehlikova, minister for human rights and ethnic minorities, told Pravo. „This is normal practice. For instance, Australia accepts hundreds of similar refugees. For Cubans we are a host country, a kind of temporary home until such time as the situation in their country changes,“ she added.

„After 1968 various countries accepted tens of thousands of Czechs and Slovaks. Why should the Czech Republic not offer something similar to people from Cuba?“ Simon Panek of the People in Need foundation told Pravo.

Carriles is a militant opponent of Castro's regime and a former employee of the US espionage service. In her decision on releasing the terrorist, Kathleen Cardone, the presiding judge of the Texas court, said that he is accused of „being connected with some of the most shocking acts of the 20th century or being mix up in them… these include the Bay of Pigs invasion, the Iran-Contras scandal, the bombing of Cubana flight 455, the bombs at tourist facilities in Havana in 1997, and according to some theorists also the murder of President John F. Kennedy.“

Cuba also accuses Carriles of an assassination attempt on Fidel Castro in 2000 in Panama, where Carriles was imprisoned for a short time afterward. Venezuela is searching for him as a fugitive from investigative custody concerning an attempt at blowing up a plane.

Un médico, perteneciente a los servicios médicos del Ministerio de Interior, le habría confirmado que tiene un prolapso (deslizamiento hacia abajo) de los conductos digestivos.

Juan Carlos González Leiva se encuentra en el vórtice del terror. Solo escucha el vocerío de sus torturadores que anuncian el linchamiento blandiendo garrotes y pancartas con mensajes de una caligrafía tosca y denigrante. No sé que piensa mientras la turba le insta a que salga de su casa para convertirlo en despojos humanos o le cubre las ventanas con improperios de la peor connotación. Eso ocurre casi a diario frente a su domicilio e en sus alrededores. Es la misma escenografía puesta para quebrar su voluntad y hacerle doblar la cerviz como un cordero. Él se niega a pactar con la humillación, apunta con sus ideas al asedio. Así resiste los embates de las hordas que practican, con puntualidad, el aquelarre. Sus órbitas oculares aguardan lóbulos que no responden a las intenciones de captar el mundo exterior. Tiene en el cerebro un bulto de sombras que le tributa la ceguera. La invidencia es tan real como el odio de quienes persisten en ahogarlo con altisonantes amenazas o impedirle el sueño con altavoces que expiden consignas y canciones del repertorio político de día y de noche. Ya es común el vandalismo, los golpes contra todo aquel que se atreva a visitarlo, los cortes en los servicios de electricidad y agua. Juan Carlos se encuentra técnicamente preso. No son necesarios para sus carceleros una jaula, ni un par de candados. A ellos les sobra la impunidad y la arrogancia para ejercer el papel de verdugos. El delito que le atribuyen consiste en presidir la Fundación Cubana de Derechos Humanos y desde allí poner en la picota pública los actos que vulneran las libertades fundamentales dentro de las fronteras del país que los niega rotundamente. Los paladines del maltrato son gentes de barrios aledaños. Todos prestan su voz para atormentar a un ciego que no teme morir por una causa que considera justa. Desearían arrastrarlo por las calles, colgarlo de una estaca después de apalearlo con frenesí, pero la orden no llega. Solo les está permitida la tortura que no deje huellas físicas. Mientras, disfrutan la labor encomendada. Obedecen al pie de la letra el guión a la espera de que el pulgar de alguna mano gire hacia abajo para decretar la muerte. El Observatorio para la Protección de los Defensores de los Derechos Humanos ha dado la voz de alarma. No es para menos. Juan Carlos está en peligro y podría, de persistir la intensidad del atropello, morir en circunstancias trágicas. La entidad basada en un programa conjunto de la Organización Internacional contra la Tortura y la Federación Internacional de Derechos Humanos expresa su “preocupación por los graves y permanentes actos de hostigamiento”, además, “urge al gobierno a que tome medidas oportunas y apropiadas para que todos los defensores de los derechos humanos reciban una protección eficaz”. Es posible que el régimen de La Habana pase por alto el llamado de atención de éste órgano internacional y continúe enfrascado en la proliferación de actos represivos. A 400 Kilómetros al este de la capital, en la ciudad de Ciego de Ávila Juan Carlos González Leiva extrae de entre la densidad del terror una cuota de dignidad sin ser un pilar del ilusionismo. Con su bastón se yergue como un gigante que conoce el valor de una lucha por que en Cuba exista un estado de derecho. Él puede ver el futuro con elecciones libres, libertad de expresión y de movimiento a través de sus gafas oscuras. Por eso el empeño en mantener invariable su actitud.

Raymundo Perdigón Brito has reported a case of food poisoning in Sancti Spíritus prison on 23 April because of negligence by the prison staff. SE LE NIEGAN A NORMANDO HERNÁNDEZ GONZÁLEZ EL PASEO DIARIO

Desde el 23 de abril de 2007 los guardias de la cárcel se niegan a que el periodista Normando Hernández González pueda dar el paseo diario que los médicos le han recomendado vivamente. Los médicos se lo han recomendado como tratamiento para la tuberculosis y otras enfermedades que ha contraído. Según el periodista, se trataría de una forma de venganza del gobierno cubano porque continúa haciendo trabajos periodísticos desde la cárcel.

Prison guards have been refusing to let Normando Hernández González into the exercise yard since 23 April, although his doctors have said he should walk every day because of the tuberculosis and other ailments he has contracted. Hernández said the exercise ban was a form of revenge by the Cuban government for his continuing to work as a journalist from prison. --

Señor Ministro,

Se encuentra usted a punto de efectuar una visita oficial a Cuba, los próximos días 2 y 3 de abril, por invitación de su homólogo cubano, D. Felipe Pérez Roque. Reporteros sin Fronteras, organización de defensa de la libertad de prensa, desea que esta visita contribuya a la evolución de la situación de los derechos humanos en la isla.

En efecto, es la primera vez que visita Cuba un Ministro de Asuntos Exteriores de un país miembro de la Unión Europea (UE) desde que las instituciones de Bruselas sancionaron políticamente a la isla, como consecuencia de la „primavera negra“ de marzo de 2003. Finalmente, a petición de vuestro gobierno y en nombre del diálogo con las autoridades cubanas, las sanciones se levantaron en 2005. Y en el próximo junio serán nuevamente objeto de un debate entre los Estados miembros.

Cuatro años después de aquella oleada represiva sin precedente contra la disidencia cubana, y a pesar de la reciente transición al frente del Estado, en la isla sigue habiendo 270 presos políticos, entre los que se encuentran 25 colaboradores de pequeñas agencias independientes de prensa, condenados algunos – como nuestro corresponsal Ricardo González Alfonso – a penas de entre 14 y 27 años de cárcel. Por este motivo Cuba es la segunda cárcel del mundo para los periodistas, después de China, y el único país del continente americano donde no existen libertad de expresión ni de información.

Sin embargo, Cuba, miembro del Consejo de Derechos Humanos de Naciones Unidas, se comprometió a „hacer respetar“ y „promover“ las libertades fundamentales, cuando en septiembre de 2006 asumió la presidencia rotatoria del Movimiento de los No-alineados.

El diálogo con el gobierno de La Habana, que hace oídos sordos a los llamamientos de la comunidad internacional, no impide en absoluto la firmeza. Usted representa a uno de los pocos gobiernos que pueden recordar a las autoridades cubanas sus deberes de humanidad y justicia. Los disidentes encarcelados tienen que recobrar la libertad.

Agradeciéndole la atención que pueda prestar a nuestra petición le ruego, Señor Ministro, reciba la expresión de mi mayor consideración.

SANTA CLARA, Cuba – 1 de abril (Yoel Espinosa Medrano, Cubanacán Press / www.cubanet.org) – El pasado 27 de marzo el periodista independiente Juan Carlos Herrera Acosta, recluido en la prisión camagüeyana Kilo 8, fue amenazado con la reclusión en una celda de castigo si continuaba sus denuncias a través de la prensa independiente, según comunicó vía telefónica a esta agencia la esposa del Juan Carlos, Iliana Hardy, Dama de Blanco. Hardy informó también que aunque Juan Carlos tenga que soportar las sanciones más crueles por parte de la dirección del penal, no cesará en facilitar a los comunicadores alternativos noticias sobre las condiciones de los penados, la falta de atención médica, la inadecuada alimentación, así como la violación del derecho al uso reglamentario del teléfono y la obstaculización a las visitas familiares y conyugales. „Confío en que organizaciones internacionales tan prestigiosas como Reporteros Sin Fronteras y la Sociedad Interamericana de Prensa, den a conocer al mundo, sobre está nueva trasgresión de mis derechos como prisionero“, dijo Herrera Acosta a la esposa. Herrera Acosta fue condenado a 20 de años de privación de libertad en abril de 2003, durante la represión desatada por el gobierno contra opositores pacíficos, periodistas y bibliotecarios independientes, conocida como Primavera Negra.
